The petitioner is the husband of the victim lady who succumbed to 100% burn injury. The petitioner says that the mother-in-law and the sister-in-law of the victim have been granted bail. He is in custody for more than two years. He should be enlarged on bail.

We have seen the material in the Case Diary. Although the 'dying declaration' of the victim does not mention this petitioner, statements of witnesses in the Case Diary specifically implicate the petitioner as having been a party to the alleged incident of the victim being set on fire.

In view of the nature and gravity of the charge, we are not inclined to entertain the petitioner's prayer for bail, at this stage. Accordingly, the application for bail being C.R.M. 4697 of 2021 is dismissed.

However, in view of the lengthy detention of the petitioner, we request the learned trial Court to expedite the consideration of charges and generally bring the trial to an early conclusion to the extent the business of the Court may permit.
