Learned advocate appearing for the petitioners 24.06.2025 Court No. 35 M/L. 52 Rakib submits that petitioners are being restrained by the private respondents from entering their land. Further the private respondents have stacked materials in thier land for which they raised objections but the private respondents are ignoring the same. Representation to that effect was to the Inspector-in-Charge, Chandannagar Police Station, however, no steps have been taken till date.

State has submitted a report. Report reflects that on receipt of the information police authorities have drawn up proceedings under Section 126 of the BNSS on or about 06.05.2025.

Since the proceedings under Section 126 of the BNSS have been drawn up by the police authorities against the private respondents, I direct that in case

petitioners enters the property the police authorities would ensure that there is no breach of the peace and/or tranquility and/or any untoward incident arising from the strained relationship between the petitioners and the private respondents.

With the aforesaid observations WPA 10785 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
