1. Learned advocate appearing on behalf of the petitioner is present and submits that the matter being infructuous is liable to be disposed of.

2. The revisional application was filed challenging one order dated 21.03.2015 passed by the learned Judicial Magistrate, 4th Court, Burdwan in G.R. Case No. 1222 of 2001 and it is also seen from the record that there was no interim stay order granted by this Court.

3. From the impugned order, it is found that accused remained absent by an application under Section 317 of the Code of Criminal Procedure and witnesses were examined fixing date for examination of accused under Section 313 of the Code of Criminal Procedure.

4. Considering all facts and circumstances and after perusal of the order as well as submission advanced on behalf of the petitioner, the instant revisional application is dismissed being infructuous.
