Sarfaraj Nawaj ...for the petitioners Mr. Debajyoti Deb ...for the State Learned counsel appearing on behalf of the petitioners submits that the petitioners are innocent housewives. They have been falsely implicated in this case. In fact, 34 persons have been made accused in a murder case.
Learned counsel appearing on behalf of the State relies on the case diary and opposes the prayer for anticipatory bail. He submits that both the petitioners were specifically named in the FIR. Their specific roles in perpetrating the crime would be evident from a plain reading of the FIR as also the statements of witnesses including the eye-witnesses. The name of the petitioner no.2 has been taken by eye-witnesses who have made their statements before the learned Magistrate as well. He also refers to the post mortem report. The other similarly circumstanced co-accused were denied the benefit of anticipatory bail by this Court on 22.05.2026 in CRM (A) 1366 of 2026.
Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail.
Accordingly, the application for anticipatory bail is rejected. Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible. (Jay Sengupta, J.)
