Debjani Sengupta, learned counsel Court No. 22 02.02.2023 (Item No. 64) (AB) appearing for the petitioner submitted that, during long pendency of this contempt proceeding the incumbents are changing. The present incumbents need to be impleaded as alleged contemnors.
Leave is granted to the petitioner to carry out the necessary addition in the cause title of the contempt application and other relevant places wherever necessary by putting the signature of the advocate on record of the petitioner.
A copy of the contempt application is directed to be served upon the present incumbents, namely, Sri Anoop Kumar Agarwal and Smt. Upali Roy (nee Mukherjee) and shall file an affidavit of service when the matter shall be taken up next.
Learned counsel for the petitioner filed today an affidavit of service showing that the contempt
notice have duly been served upon the alleged proposed contemnors, the present incumbents. Such affidavit of service is taken on record.
Another affidavit of service showing service of contempt application on the already impleaded contemnors, is also taken on record.
Mr. T. M. Siddiqui, learned counsel appeared for the alleged contemnors. He submitted that, an appeal had been preferred from the order in contempt in the year 2019 being FMA 56 of 2020. However, no order has been passed in the appeal till date. Mr.
Siddiqui prayed for few days accommodation in the matter if the appeal can be taken up in the meantime.
Considering the submissions of the parties, the contempt application shall appear on February 16, 2023 under the heading "Contempt Application". It is made clear that, since the petitioner despite having adjudication in her favour could not get the relief so long, the contempt application may be considered on the adjourned day.
