P.P Mr. Sandip Chakrabarty ... for the State Learned advocate appearing for the petitioners submits that the petitioners are in custody since 10th February, 2020 and till date only three witnesses have been examined after the charge was framed by the learned Special Court. It has also been submitted that there are 13 witnesses on which the prosecution propose to rely to prove its case and the report so called for from the State reflects that the next date has been fixed by the learned court from 8th June, 2022 to 10th June, 2022. The report so submitted by Mr. Sandip Chakraborty, learned advocate appearing for the State be kept with the record.

Having regard to the period of detention and the manner in which the proceeding is progressing before the Special Court, I am of the view that the learned trial court should fix such schedule of three dates as is already fixed on each and every 45 days, so that the trial of the case can be concluded within a reasonable period of time.

No unnecessary adjournment should be granted to either of the parties and before a date has been fixed, an assurance must be

received from the Public Prosecutor conducting the case by the learned trial court regarding the availability of the witnesses. With the aforesaid observations CRR 1443 of 2021 is disposed of.
