Report submitted by Mr. Mukherjee, learned Public Prosecutor be kept with the record. The said report enclosed the statement of Mira Chakraborty. In the said statement, it has been categorically observed that she has not undertaken any settlement with the petitioner, namely, Saswati Banerjee @ Saswati Chakraborty and such statement if made before a court is completely false.
Having regard to the contentions advanced in the revisional application, I am of the opinion that prayer for quashing which was principally on the grounds of settlement having not been taken place between the parties is not acceptable to this Court. However, the case was initiated in the year 2018 at Bidhannagar South Police Station and consequently charge-sheet was submitted on or about 30th March, 2019.
Having regard to the fact that more than four years have passed since the initiation of the case and charge is yet to be framed as submitted by the learned advocate appearing for the petitioner, I direct the learned trial court in seisin of the matter to take steps for consideration of charges and progress with the trial of the instant case.
With the aforesaid observations, CRR 1441 of 2021 is disposed of.
Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
