89 17.11.2022 Sc Ct. no.22 WPA 10234 OF 2022 -------------- Sk Hafijuddin & Ors.

Vs.

The State of West Bengal & Ors.

Mr. Parvej Anam ....For the Petitioners Mr. Bhaskar Prasad Vaisya Mr. Sagnik Chatterjee.

....For the State Mr. Nadeem Sulaiman ....For the Madrasah Board Mr. Kanai Lal Samanta ....For the Respondent Nos. 10 & 11 Some of the petitioners claim they are the members of the Managing Committee of the relevant madrasah. They alleged that the Mukhya Samprasarak of the relevant madrasah has committed several financial misappropriation and/or misdeeds. They claim that despite representations being made no step has been taken. Some of the petitioners, they claimed themselves to be the resident of the same village and locality of the same Madrasah.

On a plain reading of the averments made in the writ petition and after considering the rival contentions raised by the learned counsel appearing for the parties and on perusal of the materials on record it appears to this Court that firstly, the petitioners do not have any locus to maintain this writ petition; secondly, the

petitioners seek that their representation at page 61 to the writ petition should be directed to be considered by the concerned District Magistrate of the relevant district where the madrasah is situated.

The District Magistrate is no way connected with the administration of the said madrasah. The madrasahs are being administered and its affairs are being managed and looked into by the respective statutory bodies under the relevant statute.

For the foregoing reasons and discussions, this Court is of the firm view that this is wholly a misconceived writ petition and devoid of any merit. In view of the above, this writ petition WPA 10234 of 2022 stands dismissed, without any order as to costs. Photostat certified copy of this order, if applied for, be furnished expeditiously.
