Heard the learned Counsels appearing on behalf of the parties.
Learned Advocate for the petitioner contends that there is delay in lodging the first information report. He is in custody for about 129 days.
Learned Advocate for the State opposes the prayer for bail.
We have considered the materials on record including the statement of the victim girl recorded under Section 164 of the Code of Criminal Procedure. It appears that minor victim was kidnapped and forcibly raped.
In view of the aforesaid facts, we are not inclined to grant bail to the petitioner at this stage.
Accordingly, the prayer for bail of the petitioner is rejected.
