The writ petitioner has lodged a complaint against the private respondent of having committed offence under the POCSO Act against his minor daughter. The private respondent, in turn, has also lodged a complaint against the petitioner under the POCSO Act. Dum Dum Police Station has registered an FIR and is conducting investigation. Dum Dum Police Station is directed that investigation into the matter be completed as expeditiously as possible and charge sheet may be filed before the Jurisdictional Magistrate.

Instructions filed by the O. C., Dum Dum Police Station dated 22nd July, 2021 are taken on record. It appears to this Court from the submissions of the parties that the proceedings are as a result of a political rivalry between the petitioner and the private respondent.

This Court notes with anguish the manner in which the petitioner and the private respondent have made allegations using their minor daughters as pawns. With the aforesaid observations, the writ petition is disposed of.

There will be no order as to costs.

All parties are directed to act on a server copy of this order on usual undertakings.
