Nayan Pal @ Prabir Pal v. State Of West Bengal
13.06.2022.
80.
Ct.No.28 as (Rejected) C.R.M. (DB) 1643 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Katwa P.S. Case No.355 of 2019 dated 18.07.2019 under Sections 302/34 of the Indian Penal Code.
In the matter of : Nayan Pal @ Prabir Pal.
... Petitioner.
Mr. S. S. Mondal, Ms. Arunima Das Sharma.
...for the Petitioner.
Mr. Neguive Ahmed, Ms. Aytantika Ray.
...for the State.
Heard the learned Counsels appearing on behalf of the parties.
Having considered the materials on record prima facie disclosing involvement of the petitioner in the murder and as trial is in progress, we are of the opinion that this is not a fit case to grant bail to the petitioner.
Accordingly, the prayer for bail of the petitioner is rejected.
However, in view of the protracted period of detention suffered by the petitioner, we request the trial court to conclude the trial at an early date preferably within one year from the next date fixed for recording evidence without granting unnecessary adjournment to either of the parties.
