The present revisional application has been preferred challenging the proceedings arising out of Chakdaha Police Station Case No. 702 of 2011 dated 27th September 2011, wherein the investigating agency after completion of investigation submitted charge sheet under Sections 468/472/420/419 of the Indian Penal Code vide charge sheet no. 89 of 2012 dated 28th February 2012. The order dated 13th March, 2012 reflects that the learned Magistrate took cognizance of the offence on the charge sheet filed by the investigating agency.

Having regard to the fact that the issues so canvassed are question of facts and the documents which are not of unimpeachable character, I am of the view that no interference is called for at this stage of the prosecution commencing.

Accordingly, CRR 1582 of 2012 is dismissed.

Pending application, if any, is consequently disposed of. Interim order, if any, stands vacated.

The department is directed to send back the Lower Court Record forthwith to the jurisdictional Court, preferably within a period of seven days.
