The petitioners are aggrieved by the warrant of arrest so issued by the learned Chief Judicial Magistrate, Paschim Medinipur in connection with G. R Case No. 2834 of 2019 arising out of Anandapur P. S. Case No. 110 of 2019 dated 15th August, under Sections 341/326/307/506/34 IPC & 4(b) ES Act.

Records reflect that the petitioners were granted anticipatory bail vide CRM 8952 of 2019. The provisions of sub-section (3) of Section 438 of the Code of Criminal Procedure provides that in case there is an order of

anticipatory bail, the learned Magistrate at the first instance should issue bailable warrant.

Having regard to the provisions of law and the fact that the learned advocate for the petitioners undertakes that the petitioners would surrender before the jurisdictional court within a period of four weeks from date, I am of the view that the warrant of arrest so issued be stayed for a period of five weeks from date.

The petitioners are directed to appear before the learned Magistrate and pray for regular bail within the aforesaid period.

With the aforesaid observations, the present revisional application being CRR 1444 of 2021 is disposed of. All parties are to act on the server copy of this order duly downloaded from the official website of this court. ( Tirthankar Ghosh, J. )
