The petitioner has filed the present application praying for a direction upon the police authority to give protection to the petitioner to get electric connection in the shop room situated at 125A, Diamond Harbour Road, P.S. - Thakurpukur, South 24 Parganas, Kolkata - 700063.

2. Learned Counsel for the petitioner submitted that the petitioner is a bona fide tenant in respect of the premises-in-question. There was a civil dispute and the learned Court of Additional District Judge, 10th Court at Alipore by a judgment and decree dated 27th September, 2022 declared the plaintiff has a bona fide tenant over the premises-in-question. He submitted that he has applied for an electric connection in the premises but due to the objection raised by the private respondent, the authorities are not in a position to provide electric connection in the premises authorities.

3. Learned Counsel for the respondent/CESC submits that CESC has already provided electric meter in the name of the petitioner but the private respondent no. 6 is prevented the petitioner for getting the electric connection from main switch due to which the connection could not be provided.

4. In view of the above, the Officer-in-Charge of the Thakurpukur P.S. is directed to provide appropriate police protection to the petitioner to get the electric connection connected through the main switch to the meter board provided in the premises of the petitioner.

5. It is made clear that the petitioner shall make necessary arrangement for getting the said connection from the switch board to the meter board of the petitioner through the local electrician. It is made clear that all the cost of the police protection and the other work shall be borne by the petitioner.

It is further made clear that if the police authority found that there is some pad lock in the main switch for getting the electric connection in the meter of the petitioner's premises, the petitioner shall make necessary arrangement to open the pad lock in the presence of the police authority and after getting the electric connection, the petitioner put a new pad lock in the said connection and will hand over the key to tenant-respondent.

7. With the aforementioned observation, the instant writ petition being WPA 11673 of 2024 is disposed of.

8. Though the instant writ petition is disposed of without calling of the affidavits, all the allegations made therein are deemed to have been denied.

9. Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
