Learned advocate for the petitioner submits that she preferred an application under Section 12 of the P.W.D.V Act, 2005 which is pending before the learned Judicial Magistrate, Bidhannagar.
Learned advocate submits that pursuant to filing of the said case she also preferred an application for interim reliefs on 11th August, 2022.
The opposite parties/respondents filed application for maintainability of the proceedings on 16th November, 2022. According to the learned advocate till date the prayer for interim reliefs have not been disposed of and at least six dates have been fixed in the last one year which for various reasons are only stretching the time.
In view of the prayer advanced by the learned advocate for the petitioner and the limited purpose for which the revisional application has been preferred, I direct the learned Judicial Magistrate, Bidhannagar to dispose of the prayer for interim releifs
filed at the instance of the present petitioner which was earlier filed on 11th August, 2022 by 4th October, 2023.
With the aforesaid observations, the present revisional application being CRR 1657 of 2023 is disposed of. As it has been informed that the next date has been fixed before the learned Judicial Magistrate on 7th July, 2023, learned advocate appearing for the petitioner would be at liberty to communicate this order to the learned Magistrate so that proper dates be fixed for conclusion of the application for interim reliefs dated 11.08.2022.
Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. Urgent Photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities. [Tirthankar Ghosh, J]
