Learned counsel appearing on behalf of the O.P. No. 1 submits that the present application has been preferred as the Debt Recovery Appellate Tribunal was lying vacant as appearing from their averment in paragraph 21 of the application. He further submits that, the Appellate Tribunal is now functioning and accordingly petitioners might have lost interest with the present application.

In the above facts and circumstances and as the petitioners are found absent, let C.O. 1288 of 2021 be dismissed for default without any order as to costs. Interim order, if any, stands vacated.
