Mr. Saryati Datta ....for the State Post Mortem Report of the victim shows that, there are injuries in the body apart from non continuous ligature mark. There are statements recorded under Section 164 of the Criminal Procedure Code of eye-witnesses who states that, the petitioner was one of the persons involved in assaulting the victim immediately prior to the victim dying by hanging. Role and complicity of the petitioner in the incident requires investigation.

Enlarging the petitioner on anticipatory bail will be inimical to such investigation.

In such circumstances, we are unable to grant anticipatory bail to the petitioner.
