Petitioner has prayed for expediting the hearing of Misc. Case No.03 of 2020 under Section 127 of the Code of Criminal Procedure which is pending before the learned Judicial Magistrate, Bongoan, North 24 Parganas.

Having regard to the fact that the original Misc. Case is of the year 2007 and more than 16 years have passed since then, the prayer so advanced before the learned Judicial Magistrate is required to be disposed of taking into account the present price index.

It has been informed that the next date is fixed on 19th December, 2023.

Learned Magistrate within three months from 19th December, 2023 would dispose of the application under Section 127 of the Code of Criminal Procedure. Needless to state that the learned Magistrate would be at liberty to fix as many as number of dates as it would deem fit and proper for the purposes of affording opportunity to both the parties. However, by 19th March, 2024 the application under Section 127 of the Code of Criminal Procedure

should be disposed of.

With the aforesaid observations, CRR 1660 of 2023 is disposed of.

Pending connected application, if any, is consequently disposed of.
