And In Re : Ajijul Sekh @ Azizlu Sk ...... petitioner Ms. Minoti Gomes Mr. Amanul Islam Mr. Sourav Mukherjee ....for the petitioner Mr. Avishek Sinha ....for the State The victim in her statement recorded under Section 164 of the Code of Criminal Procedure makes out a case for investigation.

According to her, she was informed about kidnapping of her husband by the petitioner, promised to be taken to Mumbai while she was actually taken to Bangaluru and raped there. The petitioner is complicit in the offences alleged by the victim. Considering the gravity of the offence and the involvement of the petitioner in the incident as transpiring from the materials in the case diary, we are unable to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 1906 of 2023 is dismissed.
