1. Affidavits-of-service filed by the petitioner in Court today are taken on record.

The writ petitioner is aggrieved with the temporary grant of licence to the private respondent, without undergoing any tender process, to run two Ferry Ghats to the private respondents within (i) Ramganga Gadamthura Nabam Khanda to Partharpratima Dakshin Shibganj and (ii) Dakshin Laxmi Narayanpur to Khetramohanpur. The writ petitioner's other contention is that he has been one of the tenderers in response to the notice of tender dated January 8, 2024 by the respondent authority.

Bhattacharya, learned Advocate appearing for the writ petitioner has

submitted that his client has already submitted a representation to the Block Development Authority, Patharpratima (Ramganga), South 24-Parganas dated April 15, 2024, to consider his grievance as stated above.

4. Mr. Bhattacharya has submitted that the said written representation may be considered by the concerned authority.

5. Mr. Banerjee, learned Advocate appearing on behalf the State respondents submits that no urgency in the present matter has been pleaded.

6. It appears from the record that by dint of leave of the concerned Court, the matter is being moved today before this Vacation Bench.

7. Considering the same and innocuousness of the prayer of the petitioner, the writ petition is being disposed of with the direction upon the District Magistrate, South 24-Parganas, Alipore, New Treasury Building, Kolkata to consider and dispose of the writ petitioner's representation dated April 15, 2024 (copy of which has already been advanced to his office) in accordance with law.

8. In doing so, the concerned respondent shall afford an opportunity of hearing to the writ petitioner and any other persons as he may think fit and proper.

9. The representation and prayer of the writ petitioner shall be disposed of by the respondent as above with a reasoned order within a period of six weeks from date and the same be communicated to the writ petitioner.

Since this Court has not entered into the merits of this case, all points involved in this writ petition are kept open.

However, the allegations so made against the respondent authorities are treated to have been denied.
