Petitioner Mr. Souvik Mitter Ms. Rajnandini Das .....For the Petitioner This is an application for expeditious hearing of a proceeding under Section 127 of the Code of Criminal Procedure, 1973. The application was filed by the petitioner against the opposite party on December 4, 2019, and it has been submitted by the Petitioner that thereafter there has been no effective progress in this case thereafter.

Though a maintenance application needs to be heard expeditiously, in the Pandemic situation, the delay in disposal of the maintenance application cannot be attributed to the learned Magistrate, in the court below.

However, in view of the innocuous nature of the prayer made by the petitioner, this application is disposed of by directing the learned Magistrate in the court below to dispose of case no. 535M/2019 as expeditiously as possible, preferably within a period of six months from the date of the resumption of the normal functioning of the court.

Since the opposite party shall not be prejudiced by this order, this application is disposed of without any notice to the opposite party.

Accordingly, CRR 1451 of 2021 is disposed of. All parties are to act on the server copy of this order duly downloaded from the official website of this court. (Kausik Chanda, J.)
