In view of the innocuous nature of the order proposed to be passed, no prior service of notice on the opposite parties is deemed necessary.

C.O.1291 of 2021 is disposed of by requesting the Civil Judge (Senior Division), Second Court at Contai, District- Purba Medinipur, to dispose of the pending application under Order 21 Rules 97-101 of the Code of Civil Procedure in connection with Title Execution Case No.1 of 2018, also pending in the said court, as expeditiously as possible, preferably within three months from the date of communication of this order to the court below.

The Executing Court shall, after disposal of the application under Order 21 Rules 97-101 of the Code, proceed to dispose of the execution case itself at the earliest, preferably within two months thereafter. The court below as well as the parties shall act on the written communication of the learned advocate for the

petitioner, accompanied by a server copy of this order, without insisting on prior production of the certified copy. The petitioner shall communicate this order, along with server copies of the same, on the opposite parties and/or the advocates appearing for the opposite parties in the executing court at the earliest.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
