Debolina Ray Mr. Asim Kumar Datta Ms. Iqra Rahaman ....for the Petitioner This application under Article 227 of the Constitution of India is at the instance of the defendant praying for a direction upon the learned Civil Judge (Senior Division) Sealdah to dispose of the application under Order 6 Rule 17 in connection to the Title Suit No. 41 of 2015 expeditiously.

The learned advocate appearing for the petitioner submits that in the meantime the hearing of the application under Order 6 Rule 17 of the Code of Civil Procedure has been concluded and the date has been fixed for passing orders. He submits that a direction be passed upon the learned Trial Judge to dispose of the same expeditiously.

In view of the order sought and proposed to be passed, this Court feels that there is no necessity to direct issuance of any notice upon the opposite party. However, learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite party or upon the learned

advocates representing the opposite party before the learned Trial Judge.

In the light of the submissions made by learned advocate for the petitioner, CO 1718 of 2025 is disposed of with the hope and trust that the application under Order 6 Rule 17 of the Code shall be disposed of as expeditiously as possible. The learned Trial Judge is further requested to make an endeavour to see that the Title Suit No. 41 of 2015 is disposed of as expeditiously as possible without granting any unnecessary adjournments to either of the parties. Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
