C.R.M. (NDPS) 571 of 2025 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure, 1973/under section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Special Case No. 14 of 2024 arising out of Baishnabnagar Police Station Case No. 145 of 2024 dated 21.02.2024 under section 21(c)/29 of the NDPS Act, 1985.

In the matter of : Rubel Sk. @ Rubel Sekh .... Petitioner. Ms. Sabrina Parveen ...for the Petitioner. Ms. Sreyashee Biswas Ms. Sanjida Sultana ...for the State. Learned counsel appearing on behalf of the petitioner submits that he was arrested on the basis of co-accused statement and nothing was recovered from his possession. He further submits that on the basis of co-accused statement 19-20 other co-accused persons were also implicated and all of them including the present petitioner were initially discharged from this case and the charge-sheet was submitted only against Delwar Seikh, the principal accused and another with the alleged recovery of 50 bottles of phensedyl cough syrup and 37 mobile phones. However, subsequently further investigation was directed by this Court and thereafter supplementary charge-sheet has been submitted against him. He further submits that since nothing was recovered from his possession, he may be released on bail on any terms and conditions.

Learned counsel appearing on behalf of the State vehemently opposed the bail prayer contending that the bail prayer of the petitioner was rejected on 06.03.2025 by this Court and she further submits that investigation is still going on. She further submits that the petitioner has criminal antecedence and if he is released on bail there is serious chance of his absconsion.

I have considered the submissions made on behalf of the both sides. It appears that this Court by an order dated 06.03.2025 was pleased to reject the bail prayer of the accused mainly on the ground that allegation of organized claim has been levelled against the petitioner and also on the ground that investigation is still going on.

Since such rejection no new circumstance has been brought to my notice to consider petitioner's bail prayer favourably.

In such view of the matter the prayer for bail made by the petitioner is rejected.

CRM (NDPS) 571 of 2025 is accordingly disposed of.

Urgent photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
