The grievance of the writ petitioner is that in the post of Assistant Headmaster in the concerned school, though the School Managing Committee has given a green signal, no steps is being taken by the Headmaster of the school.

The Headmaster of the school and also the Respondent State authorities are present.

Learned advocate for the Headmaster submits that he is quite at a loss as to taking further steps as to the selection of the Assistant Headmaster as the President of the Managing Committee of the school and the intending candidate for the post of Assistant Headmaster being the petitioner are full-blooded

brothers. However, for that reason the selection process for the Assistant Headmaster cannot be kept pending.

I direct the concerned District Inspector of Schools (S. E.), Malda being the Respondent no.3 to take immediate steps within a period of two months from the date of communication of this order to constitute one Selection Committee for the post of Assistant Headmaster without being influenced by any other persons. The advertisement of selection for the post of Assistant Headmaster should be widely circulated so that all eligible candidates can participate. If it is only the Assistant Teachers of the school, only they will participate in the said selection process.

With the above directions the writ application is disposed of.
