Petitioner approached this Court as the representation dated 18.04.2025 was not considered by the Officer-in-Charge, Shibpur Police Station. Petitioner claims to have purchased the property in auction and it is further claimed that certain medical instruments were kept in the property wherein the private respondents have forcefully affixed the padlock. Petitioner claims that in spite of purchasing the property in auction from co-operative bank, petitioner is subjected to harassment by way of influential persons who have flexed muscles.
Learned advocate for the State submits that on receipt of the information a criminal case has
already been registered being Shibpur P.S. Case No.216 of 2025 dated 19.05.2025.
Having considered the fact that criminal case has already been registered, it would be the duty of the police authorities to protect the life and property of the petitioner. In case specific application is made to the jurisdictional court, the police authorities would take steps. Petitioner being witness to the case should not be subjected to any threat or coercion during the pendency of the criminal case.
With the aforesaid observations, WPA 10828 of 2025 is disposed of.
There will be no order as to costs.
Report so submitted be kept with the record.
A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
