Petitioner being widow daughter has claimed family pension since father of the petitioner died on 20th October, 1980 who was receiving pension being primary teacher. After death of father mother was in receipt of pension till her death on 11th February, 2016. Petitioner has lost her husband on 5th October, 2014 but application has been made seeking family pension on 12th March, 2025.

Considering the date of 'Legal Heir Certificate' i.e. 8th May, 2025 which is at page 20 of the writ petition it appears at the time of submitting application seeking family pension on 12th March, 2025 petitioner did not obtain 'Legal Heir Certificate'. Petitioner shall be at liberty to submit necessary documents in support of her claim of family pension at an early date before the concerned

District Inspector of Schools (PE) Purba Medinipur being respondent no. 4. If necessary documents are filed by the petitioner it is expected that respondent no. 4 shall take steps in accordance with law for release of family pension in favour of the petitioner. Writ petition stands disposed of.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
