14.06.2022 sdas rejected C.R.M. (DB) 1662 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Harwood Point Coastal Police Station Case No. 40 of 2018 dated 19.02.2018 under Sections 341/326/307/506 of the Indian Penal Code and subsequently Sections 302/201 of the Indian Penal Code. And In Re : Sripati Halder ..... petitioner Mr. Ranadeb Segupta Mr. Gobinda Chandra Baidya ... for the petitioner Mr. Saibal Bapuli, learned APP Mr. Arani Bhattacharyya ... for the State Petitioner is in custody for more than four years. Learned Counsel appearing for the petitioner submits that there is very slow progress in the trial. Learned Counsel appearing for the State opposes prayer for bail.
We have considered the materials on record. Petitioner was member of a gang one of whom had murdered the victim. In view of the gravity of the offence, we are not inclined to grant bail to the petitioner.
The application for bail is, thus, rejected. Bearing in mind the protracted period of detention suffered by the petitioner, we direct the trial court to take prompt steps to conclude the trial at an early date preferably
within one year from the next date fixed for recording evidence without granting any unnecessary adjournment to either of the parties.
