By the last order dated October 31, 2022 the petitioner was directed to serve notice along with a copy of the contempt application upon the contemner by speed post with AD and file affidavit of service.

But, neither the petitioner appears nor any affidavit of service has been filed.

The petitioner, by way of this contempt application under the Contempt of Courts Act, 1971 filed on July 11, 2003, sought for punishment of the alleged contemner/respondent concerned in the writ petition for non-compliance of an order dated April 29, 2003 passed by this court in CAN No.3557 of 2003 arising out of WP No.8144(W) of 2002.

The conduct of the petitioner shows that he is no longer interested to proceed with the application on hand. Accordingly, the contempt application stands dismissed for non-appearance of the petitioner and for his non-taking steps.
