(DB) 1664 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Chapra Police Station Case No. 243 of 2019 dated 20.08.2019 under Section 395 of the Indian Penal Code and under Sections 25(i)(a)/27 of the Arms Act.

And In Re : Milan Sk. @ Milon Sk. & Ors. ..... petitioners Md. Sabir Ahmed Mr. Apan Sahu ... for the petitioners Mr. Swapan Banerjee Mrs. Purnima Ghosh ... for the State Petitioners renew their prayer for bail.

Learned Counsel appearing for the petitioners submits that they are in custody for more than one year and ten months. Learned Counsel appearing for the State opposes prayer for bail.

We have considered the materials on record. Petitioners were identified in the course of test identification parade and stolen articles were recovered from their possession. In view of the aforesaid incriminating materials and as their prayer for bail was rejected earlier, we are not inclined to grant bail to the petitioners.

The application for bail is, thus, rejected. Trial court is requested to conclude the trial at the earliest without granting any unnecessary adjournment to either of the parties.
