Indrani Mukherjee Saha Mr. Shibendra Nath Chattopadhyay Ms. Priyanka Chakraborty ....for the Petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Senior Division), 3rd Court, Howrah to dispose of the Title Suit No.440 of 2017 expeditiously.

In view of the order sought and proposed to be passed, this Court feels that there is no necessity to direct issuance of any notice upon the opposite party. However, learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite party or upon the learned advocates representing the opposite party before the learned Trial Judge.

From the order-sheets appended to this application this Court finds that the application under Order 6 Rule 17 of the Code of Civil Procedure is pending and the next date of hearing is fixed on 11th July, 2025.

In the light of the submissions made by learned advocate for the petitioner, CO 1720 of 2025 is disposed of by requesting the learned Civil Judge (Senior Division), 3rd Court, Howrah to take up a hearing of the application under Order 6 Rule 17 of the CPC on the next date fixed and make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties.

The petitioner is left free to approach the learned Trial Judge for a direction upon the learned Commissioner to file the Commissioner's Report expeditiously.

Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
