Mr. Manjit Singh, learned advocate, appears on behalf of the private opposite party no.2. Learned advocate refers to an order passed by the Hon'ble Division Bench in CRM 5466 of 2021 which was for cancellation of bail preferred at the instant of the present opposite party no.2. By an order dated 20.06.2022 the Hon'ble Division Bench was pleased to direct that the lower court records be sent back forthwith and steps be taken for ensuring quick conclusion of trial. By the same order, the Division Bench was pleased to direct that the trial court shall proceed with the matter with utmost expedition and conclude the same at an early date preferably within six months from the date of receipt of lower court

records without granting unnecessary adjournment to either of the parties.

Having regard to the fact that such order was passed on 20.06.2022 and more than nine months have passed since then, the learned trial court is directed to see that the progress of the case be in accordance with the spirit and tenor of the order dated 20.06.2022 passed by the Hon'ble Division Bench. In view of the aforesaid, no interference is made in respect of the order dated 05.02.2021 framing charge against the present petitioner.

Consequently, CRR 1453 of 2021 is disposed of. Photostat copy of the order dated 20.06.2022 passed in CRM 5466 of 2021 be kept with the record.

Department is directed to communicate this order to the learned trial court at the earliest.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
