The learned Advocate representing the respondents/claimants submitted to have filed an application being CAN/3/2024 which, inter alia, stated that the claimants/respondent no.

2, namely, Madhusudan Mantri expired on 29th November, 2023 during the pendency of the hearing of the appeal being no. FMA/1862/2018. It had been further stated that the legal heirs of the deceased respondent no. 2 are already on record.

The Judgment dated 13.05.2025 passed by this Court is modified to the extent that the office of the

Registrar General, High Court at Calcutta is to disburse the compensation along with accrued interest thereon as awarded in the said Judgment only in favour of the surviving respondents.

The Department is directed to delete the name of the respondent so deceased from the cause title of the Memo of Appeal.
