Mr. Dipanjan Dutta, learned advocate appearing for the State submitted a report. Report reflects that the Inspector-in-Charge attached to Domjur Police Station contacted with the organizers of the Puja Committee who represented that on 20.05.2025 and 21.05.2025 puja would be organized at local panchayat road after taking permission of the local panchayat. A declaration to that effect has also been enclosed along with the report. Petitioners have approached this Court as they were apprehensive that their property may be encroached and temporary construction for organizing puja and other activities would have been conducted.

Since an undertaking has been given before the police authorities, police authorities would ensure that in any manner the property of the present petitioners is not used by the Baniara New Mitali Sangha for any activity

relating to the puja's to be held on 20th May, 2025 to 22nd May, 2025. Police authorities would keep a strict vigil in view of the fact that the petitioners and the private respondents are presently at loggerheads over the issue relating to usage of the property.

With the aforesaid observations WPA 10759 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioners.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
