Arya Nath Mr. Argha Banerjee ....for the Petitioners This application under Article 227 of the Constitution of India is at the instance of the plaintiff No. 2 praying for a direction upon the learned Civil Judge (Senior Division), 10th Court, Alipore to dispose of the Title Suit No.113 of 2017 expeditiously. Learned advocate appearing for the petitioner draws the attention of this Court to an order dated 3rd October, 2023 passed by a Co-ordinate Bench in CO 3077 of 2023 in support of his contention that the Coordinate Bench passed a direction upon the learned Trial Judge to pass a preliminary decree within a year from the next date fixed.

In view thereof, this Court is of the considered view that there is no necessity to pass a fresh direction upon the learned Trial Judge.

CO 1722 of 2025 stands disposed of by requesting the learned Civil Judge (Senior Division), 10th Court, Alipore to take note of the order dated 3rd

October, 2023 passed in CO 3077 of 2023 and to act in accordance with the directions contained in the said order.

Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
