Smt. Swapna Ghosh (Das) Md. Younush Mondal ....for the Petitioner This application under Article 227 of the Constitution of India is at the instance of the husband praying for a direction upon the learned Additional District Judge, 4th Court, Barasat, North 24 Parganas to dispose of the Matrimonial Suit No.1390 of 2015 expeditiously.

Learned advocate appearing for the petitioner submits that the wife/opposite party herein is delaying the hearing of the Matrimonial suit.

From the order-sheet it appears that the petitioner did not take any steps in the Matrimonial suit on 12th December, 2024 and the petitioner was directed to show-cause as to why the case should not be dismissed. Learned advocate appearing for the petitioner submits that the show-cause filed by the petitioner has also been accepted in the meantime. In view of the order sought and proposed to be passed, this Court feels that there is no necessity to direct issuance of any notice upon the opposite party. However, learned advocate for the petitioner shall be obliged to forward a copy of this application along with

this order upon the opposite party or upon the learned advocates representing the opposite party before the learned Trial Judge.

In the light of the submissions made by learned advocate for the petitioner, CO 1723 of 2025 is disposed of by requesting the learned Additional District Judge, 4th Court, Barasat, North 24 Parganas to make an endeavour to see that the Matrimonial Suit No.1390 of 2015 is disposed of as expeditiously as possible without granting any unnecessary adjournments to either of the parties subject to the condition that the petitioner is not in default of payment of alimony or maintenance either under the provisions of the Hindu Marriage Act or under any provisions of other relevant statute.

Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
