Nabab Ali Khan And ORS. v. State Of West Bengal
10.06.2026 Sl. No.67 Ct. 28 NB C.R.M (A) 1431 of 2026 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973 corresponding to Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Rejinagar PS Case No.324/2025 dated 04.11.2025 under Sections 238/288/61(2) of the BNS and Section 3⁄4 Explosive Susbtances Act, 1908.
And In the matter of: Nabab Ali Khan & Ors.
... petitioners Mr. Arnab Ghosh, Mr. Avik Ghosh ...for the petitioners.
Mr. Krishnendu Bhattacharya, Mr. Sankalpa Bhattacharjee.
...for the State.
Learned counsel appearing on behalf of the petitioner submits that they have been falsely implicated in this case. It is alleged that after a search was conducted by a drone, some bombs were recovered from behind the house of the petitioner no.1. Learned Additional Public Prosecutor representing the State relies on the case diary and opposes the prayer for anticipatory bail. He relies on the seizure list, the recovery of bombs/remnant of bombs, as well as the statements of independent local witnesses, which clearly implicate the present petitioners. Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail to the present petitioners. The application for anticipatory bail of the petitioners is, thus, rejected.
Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
