Petitioner complains of perfunctory investigation with regard to the police complaint. According to the petitioner, the police did not seize the original documents which the private respondents submitted along with the Income Tax Return. State and the private respondents are represented. Finding such issue being raised and considering the contention of the private respondents that they did not possess the original documents submitted with the Income Tax Authorities, an affidavit was called for. The private respondents filed an affidavit claiming that they submitted photocopies of documents with Income Tax Authorities.

The stand taken by the private respondents in the affidavit, will be taken note of by the investigating authority. The investigating authority will proceed in accordance with law and submit its report before the jurisdictional court as expeditiously as possible.

WPA 11575 of 2021 is disposed of without any order as costs.
