Learned Advocate representing the petitioner submits that though investigation is continuing in connection with Durgapur Police Station Case No. 446 of 2025 dated 28.10.2025 but according to the petitioner, other sections of Bharatiya Nyaya Sanhita, 2023 are required to be clamped. Grievance of the petitioner relating to investigation is also ventilated on behalf of the petitioner.

Respondent no.5 and State-respondents are represented by learned Advocates.

Since investigation has commenced in Durgapur Police Station Case No. 446 of 2025 dated 28.10.2025, Investigating Agency is directed to take the investigation to its logical conclusion and submit report before the jurisdictional Magistrate expeditiously. However, if petitioner is not satisfied with the report to be submitted in connection with the

aforesaid criminal prosecution, petitioner shall be at liberty to approach the jurisdictional Magistrate under Section 193(9) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 5.

The writ petition stands disposed of.

There shall be no order as to costs.
