1. Learned counsel appearing on behalf of the petitioner submits that the private respondents had come up will illegal construction on Government land near the petitioner's property. This is blocking the egress and ingress to the petitioner's property. Accordingly, the petitioner made a representation on 27th February, 2024 before the concerned authorities including the SDO, Domkal for taking action in terms of the West Bengal Public Land (Eviction of Unauthorized Occupants) Act, 1962.

2. Learned counsel appearing on behalf of the private respondent denies the allegations.

3. Learned counsel appearing on behalf of the State submits that in the event, such representation is pending, the same would be considered in accordance with law.

4. It appears that representation dated 27th February, 2024 is pending consideration before the concerned authorities.

5. In view of the above, the SDO, Domkal shall consider the petitioner's representation dated 27th February, 2024 in accordance with law and upon hearing all the interested parties as expeditiously as possible, preferably within eight weeks from the date of communication of this order.

6. It is made clear that the merits of the case have not been called for.

7. With the above observations, the writ petition is accordingly disposed of.

8. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

9. Urgent Photostat certified copy, if applied for, be given to the parties upon compliance with all requisite formalities.
