Md. Wasim Akram ...for the petitioners Mr. Aniket Mitra Mr. Atulya Sinha ..for the State Learned counsel appearing on behalf of the petitioners submits as follows. The instant case is a result of rivalry between two groups of villagers over a land dispute. There are case and counter case. Injuries were received on both sides.
Learned counsel appearing on behalf of the State submits as follows. Although there are grievous injury inflicted, but one victim received multiple injuries. The names of the petitioners have been taken by the witnesses. Charge sheet, however, has been submitted. In view of the materials available in the case diary, the fact that charge sheet has been submitted and because of lack of specification about the alleged roles ascribed to each of the petitioners, I am inclined to grant anticipatory bail to the petitioners, however, by limiting their movement for a limited period.
In the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further conditions that the petitioners shall not threaten or intimidate witnesses and shall attend the jurisdictional Court on dates fixed. The petitioners shall stay outside the jurisdiction of English Bazar Police Station for a period of six months from this date, except for attending Court or meeting the Investigating Officer. The application for anticipatory bail is, thus, disposed of. (Jay Sengupta, J.)
