The State of West Bengal and others No one is appearing on behalf of either of the parties. The present matter is an old pending one pertaining to the year 2016. The matter is appearing in the list since 14.11.2022 and has been called on each day of working of this Court till now. In spite of that the petitioner is not represented. Hence without wasting any further time, the case is taken up for disposal on merit. In this revision, the petitioner has challenged an order dated 30.09.2015 passed by the trial court in connection with Patuli P. S. Case No. 54 dated 22.01.2014 under Sections 498A/406/34 of the IPC. By dint of the said order, the Court has discharged the accused persons from the case, after noting the petitioner's physical absence and absence of intention to proceed with the case.
The present revision is preferred challenging the said order on the ground that the same is de hors of law, the Court has failed to apply judicial mind as well as the jurisdiction vested in it by lay while passing the order impugned in this case, that the order is a nullity in the eye of law and the same is to be set aside.
trial court as above. Therefore, in my considered opinion, the present revision is meritless and the same is liable to be dismissed. On the discussion as above, CRR 1498 of 2016 is dismissed. Photostat certified copy of this order, if applied for, be given to the parties on urgent basis.
