The grievance of the petitioner is directed against illegal and unlawful encroachment by the private respondents.

Mr. De appears for the State respondents and submits that in terms of an enquiry report conducted by the Executive Engineer, it has been found that the private respondents have encroached on the Government land and appropriate action has been taken against the private respondents under the National Highways Act.

In view of the submissions made on behalf of the State respondents and particularly in view of the fact that an appropriate proceeding has been initiated under the National Highways Act, WPA 11597 of 2021 is disposed of by directing the Executive Engineer being the respondent no.6 to conclude the proceedings after giving a right of hearing to all the affected parties

within a period of two months from the date of communication of this order.
