The petitioner has alleged that despite there being an order from the Special Secretary, Government of West Bengal, Department of Panchayats and Rural Development, Uttar Dinajpur by which the petitioner has been considered to be eligible for pension, the pensionery benefits of the petitioner has not yet been disbursed. It appears that the copy of the said order issued by this Special Secretary to the Government of West Bengal dated February 7, 2020 pursuant to a direction by the court, was also forwarded to the District Magistrate, Uttar Dinajpur and the District Panchayats & Rural Development Officer, Uttar Dinajpur. Despite having received such communication, the pensionery benefits of the petitioner who is a retired employee of the Altapur-II Gram Panchayat has not yet been disbursed. Pension is not a bounty or a charity given by the employer to its employees. It is a recognition and a reward for the service rendered by the employee and the same should be released the minute the employee

becomes eligible for it.

The writ petition is disposed with a direction upon the respondent nos. 5 and 6 to take immediate steps for disbursement of the admissible pension of the petitioner. Current pension shall be released from the month of October, 2021 in accordance with law and on the basis of the order issued by the Special Secretary, Government of West Bengal. The arrear pension on and from May, 2014 to September, 2021 shall be paid in 20 equal monthly instalments. First of such instalment shall be paid along with the monthly pension for October, 2021. If this order is not complied with then, the petitioner shall be entitled to approach the appropriate forum for payment of interest in accordance with law.

The writ petition is, thus, disposed of.

There will be no order as to costs.

All parties are directed to act on the basis of the server copy of this order.
