(A) No. 2669 of 2022 sl no. 111 In Re : An application for anticipatory bail under section 438 of the Code of Criminal Procedure in connection with Hili P.S Case No. 04 of 2022 dated 05.01.2022 under Sections 17/18/27A of the Drugs and Cosmetics Act and added Sections 21 ( c)/22 (c)/23(c ) of the N.D.P.S. Act.

Mr. Saryati Dutta ...... for the State We have considered the materials on record. Weight of seized contraband is below commercial quantity.

In view of the aforesaid fact and extent of complicity of the petitioner in the alleged crime, we are inclined in granting anticipatory bail to the petitioner.

Accordingly, we direct that in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs. 10,000/- with two sureties of like amount each, to the satisfaction of the Arresting Officer and also subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.

Petitioner shall appear before the court below and pray for regular bail within four weeks from date.

The application being CRM (A) No. 2669 of 2022 is disposed of.
