1. Mr. Shraff, learned advocate representing the petitioner would submit that there are formal defects in the writ petition, as such, he seeks leave to withdraw the same with liberty to file afresh on the selfsame cause of action.

2. Mr. Banerjee, learned advocate representing the CGST & CX authorities and Mr. Sanyal, learned advocate representing the State do not oppose such prayer.

3. Having regard thereto, the writ petition is dismissed as withdrawn with liberty to file afresh on the selfsame cause of action.
