CESC Limited and another (Via Video Conference) Mr. Indranil Halder .... for the petitioner Mr. Sagnik Roy Chowdhury .... for the CESC Limited When the matter is called on for hearing, an adjournment is sought on behalf of the distribution licensee. However, in view of the present challenge having been preferred against the refusal to grant a new electric connection to the petitioner on the ground of splitting of load, there is no scope of interference by the writ court in view of the availability of a more efficacious alternative remedy before the concerned Grievance Redressal Officer (GRO).

As such, WPA No.11602 of 2021 is disposed of with liberty to the petitioner to approach the concerned GRO with the issues involved in the present writ petition. If so approached, the GRO shall deal with the same in accordance with law preferably within four weeks from the date of such approach,

upon giving appropriate opportunity of hearing to all the interested parties.

The previous direction for affidavits, if any, stands infructuous.

It is deemed that the parties do not admit any of the contentions raised by each other, either in the writ application or in the arguments.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
