The wife seeks transfer of Matrimonial Suit No. 03 of 2023 which is pending before the learned Additional District Judge, 5th Court at Barasat to any court of competent jurisdiction at Howrah.
Inconvenience caused to the wife on account of travel by leaving behind a young child of three years is the ground for such transfer.
The husband opposes such prayer and submits that it would also be difficult for the husband, who is working in a private company, to travel to Howrah by taking leave from office at regular intervals.
Considering the above circumstances and the convenience and inconvenience of the respective parties, this court directs the learned District Judge, North 24 Parganas at Barasat to transfer the Matrimonial Suit No. 03 of 2023 from the court of
learned Additional District Judge, 5th Court at Barasat to the court of learned Principal Judge, Family Court at Kolkata.
The learned Principal Judge, Family Court at Kolkata is directed to hear out the matrimonial suit in accordance with law and expeditiously, upon receipt of the records. The notices will be sent to the respective parties.
The revisional applications are accordingly disposed of.
There shall be no order as to costs.
Parties are to act on the server copy of this order.
