Mr. Apurba Kr. Ghosh ... For the petitioner. This is an application under Article 227 of the Constitution of India which is directed against the Order No. 74 dated March 22, 2024 passed by the 1st Court of learned Civil Judge (Senior Division) at Malda in the T.S. No. 44 of 2011.

The learned Trial Judge, by the order impugned has closed the evidence of the P.W.1 for the repeated failure to the defendant to cross-examine the said witness and has fixed a further date for evidence of the defendant.

In view of the conduct of the petitioner, this Court does not find any reason to interfere with the order impugned. C.O. 1529 of 2024 is dismissed without any order as to costs.
