The petitioners pray for setting aside a memo dated May 2, 2023 issued by the Executive Engineer, Malda (Agro-Irrigation) Division, Malda. 2.

The aforesaid memo is a work order for "redrilling, rejuvenation of pipe line and procurement of pipes in Bristali H.D.T.W, J.L. No.137, ML-142 at Chanchal-I Block under Chanchal (A-I) Sub-Division in the district of Malda under Core Sector for the year 2022-23". 3.

The petitioner filed an objection before the Executive Engineer in March 2024 to stop the work of rejuvenation piping work.

It appears that the work as per the work order was due to be completed within a period of ninety days. The said period of ninety days has expired long ago. At such distant point of time, the prayer of the petitioner to stop the rejuvenation work cannot be allowed.

The writ petition fails and is hereby dismissed. 6.

Certified copy of this order, if applied for, shall be made available to the parties.
